Power of Attorney for Divorce and Family Cases

Authorise a lawyer or representative to act for you in a divorce, custody or other family matter when you cannot attend in person.

Family cases need careful, narrow wording

If you are abroad or unable to attend, a Power of Attorney can let a lawyer or representative act in your family case. These are sensitive matters, so the authority should be limited to what the case needs.

Courts expect particular powers to be stated, such as filing, attending hearings, receiving documents or agreeing terms. We prepare the wording so the lawyer is not stopped by a missing power.

What you will need to start

  • Passport and Emirates ID, or passport if you are abroad
  • Details of the lawyer or representative
  • Case details or the type of matter, if already filed
  • Court reference, if there is one
  • The powers you want to give, and those you want to keep

Matters this can cover

Each court and case type has its own practice, so we confirm the wording first.

  • Divorce proceedings
  • Custody and visitation
  • Maintenance claims
  • Signing or receiving court documents
  • Settlement discussions, where you choose to allow them

How the process works

  1. Discuss the matter. We confirm the type of case, whether it has been filed, and what your lawyer or representative needs.
  2. Agree the powers. We list the powers the court expects, such as filing, attending hearings and receiving documents, and whether settlement is included.
  3. Draft and review. We prepare the wording and you, with your lawyer, approve it before signing.
  4. Sign before a notary. You sign before a notary public in the UAE, or in your country if you are abroad.
  5. Translate, attest and deliver. If signed abroad, we arrange Arabic translation and attestation, then hand the document to your representative.

What to check before you sign

  • Whether the lawyer needs the power to settle or agree terms.
  • The case or matter is described correctly.
  • Your lawyer has confirmed the wording suits the court.
  • You understand how to revoke the authority later.
