Litigation Power of Attorney

Authorise a law firm or counsel to act for your company in litigation.

Litigation authority from a company

When a company is a party to a case, its lawyer needs a Power of Attorney signed by someone with authority to give one. For companies this often means a board resolution or signatory authority.

We prepare the Power of Attorney and the supporting corporate documents so the court sees a complete chain of authority.

What you will need to start

  • Trade licence and corporate documents
  • Board resolution or signatory authority
  • Details of the law firm or counsel
  • Case type and, if filed, the number

What the document can cover

The powers are set to the task you actually need done. Anything not listed is not given.

  • Filing, defending and appealing claims
  • Attending hearings
  • Receiving documents
  • Settlement, if the board allows it

How the process works

  1. Confirm who can sign. We check who has authority to give a Power of Attorney for the company.
  2. Prepare the corporate documents. We prepare the board resolution or signatory authority so the court sees a complete chain of authority.
  3. Draft and review. We prepare the Power of Attorney with the law firm’s requirements in mind and send it for approval.
  4. Notarise. The authorised signatory signs before a notary public with the supporting documents.
  5. Translate, attest and deliver. Where needed, we arrange translation and attestation, then give the documents to the law firm.

What to check before you sign

  • The signatory has authority
  • Settlement powers are board-approved
  • The firm has seen the draft
  • Expiry and revocation
